Handling Complex Divorce Cases in Illinois

Illinois operates under a no-fault divorce system, meaning couples only need to cite “irreconcilable differences” as the reason for divorce. This eliminates the need to prove fault, like adultery or abuse. To file for divorce in Illinois, at least one spouse must have lived in the state for 90 days prior to filing.

The division of property follows an “equitable distribution” model, where marital assets are divided fairly, though not necessarily equally, based on factors like each spouse’s financial situation and contributions. When it comes to child custody, courts prioritize the best interests of the child, weighing factors like parental involvement and the child’s needs. Spousal support, or alimony, may be awarded based on the length of the marriage, income disparities, and each spouse’s ability to support themselves post-divorce.

The laws in Illinois are not necessarily cut and dry, and you may need to involve various specialists, such as accountants, to protect your best interests.
